Introduction to T-MEC Labor Panels
Mexico currently has four labor panels open at the request of the United States government, addressing allegations of continued employer interference, dismissals for union activities, anti-union discrimination, and rectifying the Pirelli Neumáticos case by harmonizing the Labor Law Contract and Collective Bargaining Agreement.
Open Cases
- Industrias Tecnos: A manufacturing company facing labor disputes.
- Minera Camino Rojo: A mining company with ongoing labor concerns.
- Bader de México: A company involved in labor-related issues.
- Pirelli Neumáticos: A tire manufacturing company with a panel already established (MEX-USA-2024- 31A-03).
Pirelli Neumáticos Case Background
On August 21, a ruling was issued regarding the denial of workers’ rights at call center Atento Servicios, where Mexico’s government lost the case. The labor panel process is part of Anexo 23 A and focuses on priority sectors like manufacturing, services, and mining. If governments disagree, a panel is established to evaluate the case and impose sanctions such as suspending duty-free trade or restricting goods entry.
Government’s Position on Pirelli Case
Mexico has already presented its arguments in the Pirelli case, both for the workers and those who submitted a document to the Mexican secretariat. The analysis of these arguments is expected to lead to a ruling in upcoming weeks.
US Request for Pirelli Case Review
On August 23, 2024, the United States requested Mexico to review whether Pirelli Neumáticos workers were denied the right to free association and collective bargaining due to the company’s failure to provide workers with the most advantageous conditions of the prevailing sectoral contract (Labor Law) for the tire manufacturing industry.
Mexico’s Response
After a 45-day review period, Mexico issued a report stating no rights denial was found in the company. Conversely, the US maintained that rights denial persisted and requested the establishment of a labor panel to review the situation at Pirelli Neumáticos on December 18, 2024.
Workers’ Argument
The Mexican Labor Workers’ Union (La Liga) and the International Lawyers Assisting Workers Network, representing the workers, stated that the panel request is well-founded. They presented evidence showing a scheme intended to deprive workers of their rights. They also emphasized that without the annex 31A T-MEC protection, these harmonization acts would never have taken place, regardless of potential improvements in workers’ conditions.
