Background on the Importance of Toy Safety

As families in Mexico celebrate the traditional Three Kings Day on January 6th, authorities issue warnings and recommendations to prevent accidents and risks associated with children’s toys. The Federal Procurator for Consumer Protection (Profeco) and experts from the Mexican Social Security Institute (IMSS) highlight the consequences of poor toy choices for children, who may suffer injuries if not supervised properly.

Regulations and Standards for Toy Safety

According to the Federal Law on Consumer Protection (LFPC), there are exclusive Mexican Official Norms (NOM) for toys, such as NOM-015-SCFI-2007 on commercial information and toy labeling. This norm requires the following details:

  • Truthful information.
  • No misleading or erroneous content.
  • Product name on the packaging or box.
  • Manufacturer’s data.
  • Battery requirements, including type and quantity, if applicable.
  • Assembly instructions for adults, along with safety precautions and recommended age for use.
  • Country of origin and importer details, if applicable.
  • Labeling and instructions in Spanish; other languages may be included but must also be present.

Moreover, toy providers must adhere to specifications, materials, and quality standards. They should indicate potential risks and necessary usage information. However, they may also sell items that do not comply with the LFPC or NOM standards and might not provide purchase receipts or warranties.

Consumer Rights and Toy Safety

The lack of information on toys poses risks for children, as it violates consumer rights. Therefore, it’s crucial to thoroughly understand the details of any toy and ensure that this information is clearly displayed on packaging.

Profeco advises purchasing from established retailers to facilitate returns if any issues arise and to obtain purchase receipts and sealed warranties.
