Background on the Issue
In response to abusive practices by certain digital platforms, the Senate has approved new regulations that mandate service providers to notify users about any automatic renewals at least five days before they occur. This move aims to protect consumers from hidden fees and complicated cancellation processes.
Who is Affected?
This regulation applies to digital subscription services such as Netflix, Amazon Prime, Spotify, VIX, HBO, and any other recurring billing digital subscriptions. The senator Cynthia López Castro emphasized that if signing up for a platform takes seconds, then canceling should also be straightforward and without penalties.
Mexico Aligns with International Best Practices
The new rules in Mexico align with international best practices, such as the Click-to-Cancel rule by the Federal Trade Commission (FTC) in the United States and the European Union’s guidelines on e-commerce.
Digital Revolution and Its Impact
The rapid growth of digital technologies has transformed how people work, learn, stay informed, and entertain themselves. Following the digital surge due to the pandemic, all generations have increased their adoption of connectivity and digital tools, according to Ernesto Piedras, director of The Competitive Intelligence Unit (The CIU).
Digital platforms for movies, music, video games, mobile apps, and other online services are now integral to the daily lives of millions. These tools have become preferred means for acquiring goods, contracting services, or accessing cultural and entertainment content, as noted by diputado Ricardo Monreal in the approved initiative.
Statistics on Digital Platform Usage
The number of active users on digital platforms reached 78 million in 2024, four million more than the previous year, according to a Comscore study. The analysis focused on gaming, retail, news, social networks, and streaming/CTV (internet-connected television).
In Mexico, the most popular social media platforms are Facebook, WhatsApp, Instagram, TikTok, and X. Streaming services like Netflix, Disney Plus, Amazon Prime, and HBO lead the market, while Spotify dominates music streaming.
Challenges in Digitalization
Despite the benefits of digitalization, it has also revealed significant challenges in provider-consumer relationships and highlighted the need for a more robust regulatory framework, according to Monreal’s document.
Rising Consumer Complaints
The number of complaints related to digital services and automatic subscriptions has been increasing. In 2024, the Profeco (Federal Consumer Procurator’s Office) registered over 20,000 complaints, primarily concerning streaming platforms, gyms, software, and mobile phone services.
Common Problems with Digital Services
Frequent issues include automatic and recurring billing for services contracted through digital platforms without explicit consumer consent or renewal. Additionally, consumers often face obstacles when attempting to cancel their services, effectively making them captive and infringing on their rights as consumers.
Comparison with International Standards
Although there’s no record of the number of cases in Mexico where users face such abusive practices by global and local large companies, these incidents have been rising exponentially in recent years both domestically and worldwide.
According to Chase, a commercial banking division of J.P. Morgan, canceling recurring charges from digital platforms in the U.S. on average takes three months. Mexico aims to avoid such delays.
