Introduction to the TEPJF and Recent Changes

The Mexican electoral authority, the National Electoral Institute (INE), has validated and delivered majority certificates to two newly elected magistrates for the Superior Chamber of the Tribunal Electoral del Poder Judicial de la Federación (TEPJF): Claudia Valle Aguilasocho and Gilberto de Guzmán Bátiz García. The latter is expected to assume the presidency of the electoral tribunal.

Magistrate Janine Otálora Malassis expressed optimism about the incoming changes, stating that the arrival of new magistrates and a new president for the TEPJF will likely alter the working dynamics and criteria within the tribunal.

“Initially, it could change the working dynamics. We will have to see who presides over the Superior Chamber, as their proposals and approach will play a crucial role. Essentially, new individuals bring fresh perspectives and criteria, which is one of the significant advantages of a staggered renewal of organs,” Otálora Malassis told El Economista.

Challenges Ahead for the TEPJF

Magistrate Otálora Malassis also highlighted that the TEPJF faces significant challenges, including analyzing potential nullification of entire elections if any candidacy requests it.

“First, we will need to debate a competition to resolve impugnations of candidacies for regional chambers… We will also have to address ongoing impugnments of vote counts, as the main discussion will be whether a recount can be conducted and under what conditions, along with identifying the authority responsible for overseeing such a recount,” she explained.

Otálora Malassis acknowledged that counting votes for district court or collegiate tribunal elections presents complexities due to the ballot’s structure.

Additionally, she emphasized that the annullment of polling stations is another critical matter, as the INE has already annulled over 800 polling stations due to irregularities, but further investigation is needed to determine if additional stations require annulment or direct impugnment before the TEPJF.

She also anticipated that a candidacy might eventually request the nullification of the election, expressing confidence that all issues will be resolved before the August 28 deadline for concluding these election-related matters.
