What Cargo Will Be Elected in the Judicial Elections?

On June 1, 2025, Mexico will hold an extraordinary electoral process for the Judicial Power of the Federation, marking the country’s first judicial elections. This event is mandated by the Judicial Power Reform of September 2024, as stated by the National Electoral Institute (INE).

A total of 881 judicial positions will be elected, including:

  • 9 Supreme Court Justices of the Nation (SCJN);
  • 2 Magistrates for the Superior Chamber of the Federal Electoral Power Court (TEPJF);
  • 15 Magistrates for the Regional Chambers of TEPJF;
  • 5 Magistrates for the Judicial Discipline Tribunal;
  • 464 Magistrates of Circuit;
  • 386 District Judges and Judges.

What Are the Functions of Each Elected Cargo?

Supreme Court Justices of the Nation (SCJN)

  • They serve as the highest constitutional court.
  • Their primary function is to ensure that laws and acts of authority adhere to the Constitution and do not infringe on human rights.

Magistrates of the Superior Chamber of the Federal Electoral Power Court (TEPJF)

  • They resolve definitively and immutably electoral controversies presented by citizens, candidates, parties, and other political actors.
  • They are the last judicial organ to resolve conflicts in various popularly elected positions.
  • They also conduct the final tally of Mexico’s presidential election, declare the validity of the election of the elected president or president-elect.

Magistrates of the Regional Chambers of the Federal Electoral Power Court (TEPJF)

  • They address issues that arise in electoral processes.
  • They confirm, invalidate, or modify decisions of local tribunals on electoral disputes, except gubernatorial ones, and review INE actions.
  • They resolve state election conflicts that reach the Regional Chambers.

Magistrates of the Judicial Discipline Tribunal (TDJ)

  • The five magistrates will investigate and sanction practices contrary to the Constitution and law committed by judges, magistrates, and ministers.
  • They will form commissions and a Plenum. The Tribunal will conduct administrative responsibility proceedings in the first instance through commissions composed of three of its members. The Plenum will direct and resolve matters within its competence in the second instance.

Magistrates of Circuit

  • They review appeals against decisions of district and local judicial bodies.
  • Their work helps establish precedents for future cases, thus expanding your rights and freedoms.

District Judges and Judges

  • They resolve issues related to actions of authorities, ensuring respect for the Constitution and national laws.
  • In federal matters, they handle civil, labor, penal, administrative cases, and more to protect individuals’ rights.
  • They safeguard human rights through the Amparo Judgment process.
